Divorce procedure

Divorce must be handled in accordance with the application procedures prescribed by the law, and there are some usual steps. However, if the father and wife have children, both parties must make arrangements for the children and handle them in the divorce proceedings.
  1. The spouse of the divorce applicant submits a petition for divorce to the Registry of the Family Court, or both spouses jointly file for divorce.
  2. Where a petition for divorce is submitted, the petition must be served on the party who is the respondent, and the respondent can respond to the petition.
  3. If there is an urgent application, request to make a temporary order such as a temporary visit order, custody order or maintenance order.
  4. The affidavit can be submitted at this stage.
  5. Divorce matters will be included in the court's tentative order list.
  6. Normally, the divorce decree will not be opposed, but the two parties may have disputes about property, maintenance, custody or visitation. If the divorce is not contested, the petitioner will be summoned to verify the content of the petition and the statement regarding the arrangements for the children. This will be done publicly in the court, and the respondent can choose whether to appear in court. If the respondent appears in court, the judge will determine whether the respondent intends to contest the legal proceedings.
  7. If the two parties have reached an agreement on child custody, visitation and other matters, the judge can approve the agreement and make a final order.
  8. An application for an order absolute can be filed six weeks after the provisional decree is granted, and an absolute decree will be issued approximately two months after that.
